Terms of Sale

 

Thank you for supporting CadenJohn Photography. By placing an order on https://www.cadenjohnphoto.com/,  https://cadenjohnphotography.pixieset.com/, and https://icons.cadenjohnphoto.com/ (herein collectively the "Websites") you accept the Terms Of Sale set forth below. Please read the following terms thoroughly. These items may be updated at any time. 

 

Copyright

Title (possession) of and copyright to all products and materials appearing on CadenJohn Photography branded websites, social media, and photography albums shall remain with the Photographer until fifty (50) years after their collective death. This includes all Images, text, logos and graphics, design elements, and content used and promoted by CadenJohn Photography. All photos are copyrighted and encrypted with copyright metadata by the Photographer. The negatives or digital Images (hereinafter collectively the “Images”) created by the Photographer and/or subcontractor(s) remain the property of the Photographer. It is illegal to copy, scan, reproduce, or post online or elsewhere without the written permission of the Photographer. Violators of this federal law will be subject to its civil and criminal penalties. Permission is hereby granted to the Photographer to use any Images created under these terms for professional samples, displays, internet website pages, advertising, exhibitions, contests, and any other purpose the Photographer deems necessary. The photographer retains the copyright to all Images produced by the Photographer and/or the Photographers subcontractor(s). If purchasing hi-resolution Images on CD, DVD, Flash Drive, or digital or physical distribution including but not limited to, email, Pixieset, text, and physical prints/products the Client understands the Images given on CD, DVD, Flash Drive, or digital or physical distribution including but not limited to, email, Pixieset, text, and physical prints/products cannot be used for profit, marketing, or advertising uses unless written permission is provided by the Photographer. All uses of the Images on the internet or in print must be acknowledged as Images by the Photographer.

Limitation of Liability and Return Policy

Because of the nature of digital photography and photographic products being unable to be returned once received, all products sold by CadenJohn Photography on their Websites are NON-REFUNDABLE. CadenJohn Photography does not offer any warranties, either expressed or implied, of any kind. Replacement options may be provided for items damaged in shipping if notified via email (cadenjohn.photo@gmail.com) within 5 days of the posted delivery date via the tracking number associated with the order at the sole discretion of CadenJohn Photography.

Unless otherwise noted all returns for replacement must follow the conditions below:

- All products must be returned complete, as ordered.
- CadenJohn Photography will not accept items that have been intentionally physically damaged or abused.
- Please allow 2-3 weeks for all replacement orders to be shipped.
- Claims for missing products must be reported within 14 days from the posted ship date on the tracking number associated with the order.

 

You agree that the sole and exclusive maximum liability to CadenJohn Photography arising from any product sold on their Websites shall be the price of the product ordered. In no event shall CadenJohn Photography, its officers, employees or other representatives be liable for special, indirect, consequential, or punitive damages related to products sold. You agree that CadenJohn Photography, its officers, employees or other representatives shall not be liable for damages arising from the operation, content or use of their Websites.

 

You agree that this limitation of liability is comprehensive and applies to all damages of any kind, including without limitation direct, indirect, compensatory, special, incidental, punitive and consequential damages.

 

ORDER ACCEPTANCE POLICY

Your submission of an order and/or receipt of an order confirmation, automated or otherwise, does not signify the Photographer's acceptance of such order. CadenJohn Photography reserves the right to cancel any order they deem necessary, at their sole discretion, regardless of the order status or whether they have received a confirmation of the order. CadenJohn Photography reserves the right to require additional information from you before accepting or processing any order.

 

SHIPPING POLICY

Products are fulfilled and shipped via a partnered professional imaging laboratory. Most orders placed through CadenJohn Photography’s Websites are fulfilled and shipped via their partnered professional imaging laboratory. Orders not shipped via their partnered professional imaging laboratory will be shipped directly from CadenJohn Photography. The Customer will receive a confirmation once your order is received and shipped. 

 

SALES POLICY AGREEMENT

By placing an order with CadenJohn Photography, the customer has agreed to the terms and conditions of the sale as indicated on the Photographer’s Websites. By placing an order the customer has agreed to the total amount of the sale, and authorized CadenJohn Photography to collect payment via the payment method the customer specified. CadenJohn Photography reserves the right to make changes to this site and these terms and conditions at any time.
